Clients seeking to enhance the confidentiality of the distribution of assets, or to ease the distribution of assets by avoiding the probate process in whole or in part, often enter into revocable, or in some cases, irrevocable trusts. The same considerations that result in an effective estate plan are considered when forming a trust: effective distribution of assets; minimizing the effects of State and Federal Estate Tax laws; ensuring that the needs of children and minors are successfully provided for; and appointing executors, guardians, and conservators whom the clients trust and respect to carry out their intentions. Trust planning and creation has been a significant part of Mr. McDonald's estate planning law practice for over 25 years.
